1. Definitions and terms

triveomedia.com — a domain operated by Triveo Media AD, a legal entity with its registered office in România.

Service Provider — Triveo Media.

Client — any natural person over the age of 18, or any legal entity, that has or obtains access to the Content through any electronic means of communication made available by Triveo Media, or under an existing usage agreement between Triveo Media and that party.

Site — the platform https://triveomedia.com and its subdomains.

Quote Request — an electronic document that acts as a form of communication between the Service Provider and the Client, through which the Client conveys to the Service Provider, via the Site, their intention to purchase Services from the Site.

Services — any service listed on the Site, including the services mentioned in the Quote Request, to be provided by the Service Provider to the Client as a result of the Contract concluded between them.

Campaign — the act of commercially presenting a finite number of Services for a limited period of time set by the Service Provider.

Contract — the distance contract concluded between the Service Provider and the Client, without the simultaneous physical presence of the Service Provider and the Client.

Content means:

  • all the information on the Site that can be visited, viewed, or otherwise accessed using an electronic device;
  • the content of any email sent to Clients by the Service Provider through electronic means and/or any other available means of communication;
  • any information communicated by any means by an employee, collaborator, or official representative of the Service Provider to the Client, in accordance with the contact details specified by that Client;
  • information relating to the Services and/or the pricing applied by the Service Provider over a given period;
  • information relating to the Services and/or the pricing applied by a third party with whom the Service Provider has concluded partnership agreements, over a given period;
  • data concerning the Service Provider, or other privileged data belonging to it.

Review — a written evaluation by the beneficiary of a Service, based on their personal experience and their ability to make qualitative comments and to state whether or not the Service meets the specifications set out by the Service Provider.

Rating — a way of expressing how satisfied a Client is with a Service. The Rating is expressed in stars, with each Service able to receive a score from one to five stars. This level of satisfaction is always tied to the Review the Client writes about a Service.

Comment — an appraisal or critical observation made in relation to a Review or another comment.

Commercial Communications — any type of message sent (for example: email/SMS/mobile push/web push/etc.) containing general and thematic information, information about offers or promotions, information relating to purchased Services, as well as other commercial communications such as market research and opinion surveys.

2. Contractual documents

2.1 By sending a Quote Request through a form on the Site, the Client agrees to the form of communication (by email) through which the Service Provider carries out its commercial operations.

2.2 The Contract is considered concluded between the Service Provider and the Client at the moment the Client receives from the Service Provider, by email and/or SMS, the notification that the process of producing the ordered Service has been completed.

2.3 The document and information made available by the Service Provider to the Client through the reply email to the Quote Request sent by the Client will form the basis of the Contract, including the actual time needed to deliver the Service requested by the Client, likewise communicated by email.

3. Intellectual and industrial property rights

3.1 The Content, as defined above, including but not limited to logos, brand, stylised representations, commercial symbols, static images, dynamic images, text, and/or multimedia content presented on the Site, is the exclusive property of Triveo Media, which reserves all rights obtained in this respect, directly or indirectly (through usage and/or publication licences).

3.2 The Client is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, or include any Content in any context other than the one originally intended by Triveo Media; to include any Content outside the Site; to remove the marks that signify Triveo Media’s copyright over the Content; or to take part in the transfer, sale, or distribution of materials produced by reproducing, modifying, or displaying the Content, except with the express written consent of Triveo Media.

3.3 Any Content to which the Client has and/or obtains access by any means falls under the terms of this Document, unless the Content is accompanied by a specific and valid usage agreement concluded between Triveo Media and that party, and without any warranty, implied or express, on the part of Triveo Media in relation to that Content.

3.4 The Client may copy, transfer, and/or use Content only for personal or non-commercial purposes, and only where this does not conflict with the provisions of this Document.

3.5 No Content transmitted to the Client by any electronic means of communication or obtained by them through access, visiting, and/or viewing constitutes a contractual obligation on the part of Triveo Media and/or of the Triveo Media employee/representative who facilitated the transfer of Content, where such a person exists, in relation to that content.

3.6 Any use of the Content for purposes other than those expressly permitted by this Document or by the usage agreement that accompanies it, where one exists, is prohibited.

4. Acceptance of use of the site

4.1 By using this Site, you agree to these terms of use. Access to and use of this Site are subject to the following terms of use and to all applicable laws and regulations. By accessing and using the Site, you accept, without limitation or qualification, these terms, and you acknowledge that any other agreements between you and Triveo Media are superseded by the provisions of these Terms of Use. If you do not agree to, or do not accept without limitation or qualification, the Terms of Use of this Site, you must not use the website, its content, or its services.

4.2 Changes to the Terms & Conditions

Triveo Media has the right to change, at any time and in any way, any of the provisions set out in these Terms & Conditions, or the Terms & Conditions in their entirety, without prior notice and without being required to complete any other formality towards Users. Any change is fully and unconditionally accepted by the Users of the Site simply by using or accessing any feature offered by the Site.

4.3 Limitation of liability

Triveo Media and its officers, directors, employees, agents, or any other party involved in designing, producing, or delivering the site are not liable for direct or indirect damages of any kind that may result from or in connection with the use of this site or its content. Triveo Media assumes no responsibility and will not be liable for any damage or viruses that may infect your computer or other property as a result of accessing or using this site, or of downloading any material, information, text, images, video, or audio from this site.

4.4 Applicable law and jurisdiction

These Terms of Use and the use of this site are governed by the laws of Romania. The competent courts of Romania will have exclusive jurisdiction over any and all disputes arising from, relating to, or connected with the provisions of the Terms of Use and/or the Content of the site, or in the case of disputes in which these Terms of Use and/or this site are considered relevant facts.

5. Privacy policy

Triveo Media AD, a legal entity with its registered office in România, fully applies the provisions of the GDPR.

Personal data is collected and processed by Triveo Media only under the conditions permitted by the GDPR on the protection of individuals with regard to the processing of personal data and the free movement of such data, and in accordance with the applicable EU regulations.

By reading these Terms & Conditions, you acknowledge that you are guaranteed the rights provided by law, namely the right to information, the right of access to data, the right to erasure of data, the right to rectification of data, the right to intervene, the right to object, the right not to be subject to an individual decision, and the right to go to court in the event of any breach of your rights guaranteed by the GDPR on the protection of individuals with regard to the processing of personal data and the free movement of such data. You also have the right to object to the processing of your personal data and to request its total or partial erasure.

On the basis of a written, dated, and signed request sent to the email address [email protected], you may exercise the following rights, under the conditions provided by law:

  • to have it confirmed whether or not your personal data is being processed;
  • to intervene on the data transmitted;
  • to object to the processing of your data for well-founded and legitimate reasons;
  • to request the erasure of your data, except in the situations provided by law.

Any personal data you send on the Site by email or by any other means will be used in accordance with the Privacy Policy (access is via the Site). Any other communications or materials you send on this Site, such as questions, comments, suggestions, or similar messages, will be treated as non-confidential and not protected by any specific intellectual property rights.

In line with the latest EU provisions, Triveo Media undertakes to responsibly use the personal data automatically recorded by third-party scripts (in this case Google and Facebook) at the moment a User accesses the website https://triveomedia.com.

IP address

The IP address is sent with every request, so that the server knows where to send its responses. Every Internet user is assigned an IP address by an Internet Service Provider (ISP) as soon as they connect to the Internet. The ISP knows which IP addresses were used, when, and by which Internet user. The law requires the ISP to keep this information.

Triveo Media does not store any User’s IP address locally. Instead, we use the IP address for session recognition and geographic analysis within our third-party tool (Google).

Disputes

Any dispute arising between Clients and Triveo Media will be resolved amicably. If the conflict cannot be settled amicably, jurisdiction lies with the Romanian courts.

Security of personal data and information

The personal data entered by the buyer will be used by the Company only for the stated purpose of this site. The information in the order form is needed in order to send you order confirmations, deliver the ordered services, announce ongoing promotions, and so on, and will not be provided to any third party. The Company guarantees the confidentiality of certain information. This data does not physically exist on the servers running the website https://triveomedia.com; it is accessible only to authorised Triveo Media personnel through the internal network. Each user has the right to view only their own personal data, which they have entered. The website https://triveomedia.com uses security measures against the loss, alteration, or misuse of the information under Triveo Media’s control. In the event of information loss caused by errors in the software with which the website https://triveomedia.com is built and hosted, the Company assumes no responsibility.

6. Fraud

Triveo Media does not ask its Clients, through any means of communication (email/SMS/etc.), for information relating to confidential data such as bank accounts/cards or personal passwords.

The Client assumes full responsibility for disclosing their confidential data to a third party.

Triveo Media declines any responsibility in situations where a client is or would be harmed in any way by a third party claiming to be or to represent the interests of Triveo Media. The Client will inform Triveo Media of any such attempts, using the contact details provided.

Triveo Media does not promote SPAM. Any client who has explicitly provided their email address on the site may choose to unsubscribe from our email communications. Communications made by Triveo Media through electronic means of distance communication (i.e. email) contain the complete and accurate identification details of the sender, or links to them, at the time the content is sent.

Triveo Media reserves the right to initiate criminal proceedings against anyone who has attempted to, or has managed to, achieve the following:

  • access another Client’s data of any kind, using any method;
  • alter or modify the content of the Site, or any correspondence sent by any means by Triveo Media to the Client;
  • affect the performance of the server(s) on which the site runs;
  • access or disclose, to any third party without the necessary legal authority, the content sent by any means by Triveo Media to the Client, where that third party is not the legitimate recipient of the content.

7. Contact

By using the contact form or the service available on the site, the Client allows Triveo Media to contact them through any available means, including electronic means.

Partial or full completion of the contact form and its submission does not in any way represent a commitment on the part of Triveo Media to contact the Client.

Accessing the site, using the information presented on it, visiting the pages, or sending emails or notifications to Triveo Media is done electronically, or by any other means of communication available to the Client and Triveo Media. The Client is therefore considered to consent to receiving notifications from Triveo Media electronically, including communications by email or through announcements on the site.

Triveo Media reserves the right not to respond to all requests of any kind received through any means of communication.

8. Newsletter and alerts

When the Client submits their contact details through the Site, accepting the site’s Terms & Conditions, they may or may not give their consent to receive newsletters and/or alerts from Triveo Media.

The data collected from the Client for the purpose of sending newsletters and/or alerts may and will be used by Triveo Media within the limits of the Privacy Policy set out in the dedicated section on the site.

A Member or Client may opt out of receiving newsletters and/or alerts at any time:

  • using the dedicated link within any newsletter and/or alert received;
  • by changing their consent to receive newsletters and/or alerts, using pages in the restricted areas;
  • by contacting Triveo Media, in accordance with the contact details, with no further obligation on either party towards the other and without either party being able to claim damages from the other.

Opting out of receiving newsletters and/or alerts does not imply withdrawing the consent given for this document.

Triveo Media reserves the right to select the people to whom it will send newsletters and/or alerts, as well as the right to remove from its database any Client who has previously given consent to receive newsletters and/or alerts, with no further commitment on the part of Triveo Media and without any prior notice.

Triveo Media will not include, in the newsletters and/or alerts sent to the Client, any kind of advertising material in the form of content referring to any third party that is not a partner of Triveo Media at the time the newsletters and/or alerts are sent.

When sending a quote request, the Client has the option to give their consent to receive Newsletters.

The Newsletter is a means of periodic, exclusively electronic information (email, SMS) about services, events, promotions, etc. over a given period, with no commitment on the part of the owner regarding the information it contains. The Client may withdraw this consent at any time, with no obligation, by contacting us using the details provided or by clicking the Unsubscribe button at the bottom of each Newsletter received.

9. Final provisions

This site is owned by Triveo Media, which grants you the right to access and use the site subject to your acceptance of these Terms & Conditions. By accessing and using the site, you automatically and unequivocally agree to comply with the site’s Terms & Conditions.

Triveo Media has the right to change the Terms & Conditions at any time, without prior notice, by posting the updated version on the site. The Client is obliged to read the Terms & Conditions each time they access the site. The Client is obliged to comply fully with the site’s Terms & Conditions and cannot claim, or defend themselves with, a lack of awareness of the site’s Terms & Conditions valid at the date of accessing, using, and/or sending a quote request on the site, or of registering for an event.

Promotions offered by Triveo Media are announced on the site. Promotions become valid at the moment they are activated on the site and cease to be valid at the moment they are deactivated on the site. Promotions cannot be combined with each other or with other discounts and are valid only during the periods stated, unless the site specifies otherwise. These Terms & Conditions are supplemented by the special aspects/provisions set out in the descriptions of the products/events available on the site. In the event of any contradiction between these Terms & Conditions and the special provisions mentioned above, the special provisions take precedence.
